Why do I need permission from konstantin to make a sequel? As far as I know, hammerfight is not a trade mark name.

I think it is, at least in some territories namely russia.
But even if it wasn't, what's the point on taking someone else's work and make an unauthorized sequel for it? It would only make you look bad.
It would be one thing if he wanted you to make it but I highly doubt it's the case.

It's respectful to the author if you ask for his permission. I would be livid if someone tried to pass off a sequel to one of my games, and I would probably pursue legal action.

Instead of making a sequel you can make a spinoff?
Like:
Hammerfight: [some title here]
-A tribute to hammerfight
Or whatever. What is hammerfight anyway

Russians don't usually tend to pay attention to copyrights, anyway. You know what I mean.
You could make a direct clone of it. Call it "The Hammerside" or something.

Making a remake or tribute and clearly state what it is is flattering, but making a pseudo-sequel and try to pass it as official is an ugly move to say the least.

Well for one the game is on Steam. Also on <a href="http://www.koshutin.com/">this site</a> the title is "HAMMERFIGHT(TM)". In this case I'd not try to pass it off as an official sequel. It's up to you really though.
