Yes, they do, but all of that music is from actual existing games (GBA, NES, PS1) so they're all copyrighted.

"freely usable" = no.

If that doesn't bother you, go for it!

Haha, he wanted free to use non-midis, so you offer him copyrighted midis haha

ModArchive.org has loads of mod files created by the users there, if you want to use any of the files there you might have to ask the author's permission.

Well, if there's no contact info that's not your fault. Just put the guy's name in your credits and go for it. You can even mention that the guy has no contact info.. right in your game- Bien!!

Not correct. Copyright is and stays copyright. You ALWAYS need the permission from the author when you want to use its stuff. This counts for nearly everything available. Not only music.

There are rare cases where it is closer described what you are allowed to do with the stuff. Like when the stuff is under the Creative Commons License. But that are really rare cases. If not described, as it is with the main stuff: contact the author and ask for permission. Else you better keep the fingers away from it. Because this can turn out very expensive ...

There are exceptions to copyright, for example fair use allowance which essentially permits free use of copyrighted media provided that the derivative use does not infringe upon the copyright holder's potential to profit from the original work.

Audio/music I believe is a special case in some countries though, and always requires permission. I can only give general information since the law varies from place to place and is mostly pretty convoluted, especially the free use stuff. Generally you're safe as long as you aren't making money and you aren't preventing the copyright holder making money.


In the case of the video game music, most publishers do not give two shits about fan projects.

In the case of the ModArchive stuff, you're going to get a C&D before any legal action can begin (giving you the chance to remove the song if the composer doesn't like it), so contrary to what Tiles just said you're pretty much safe.

It's polite to send an email first though, regardless of the legal requirements.

Yeah. And if you can't find a website or email address on modarchive, then just look in the module's comments or instruments. Most artists put their email somewhere in the comments/samples/instruments.
